On 23 April 2014, the Brazilian parliament adopted the Civil Rights Framework (Marco Civil da Internet, lei n° 12.965) for the Internet. The Law introduces a set of rules concerning net neutrality. In particular, the Law stipulates that internet service providers have the duty to treat the transmission of all data packets on an equal basis, without discrimination by content, except if it is a technical requirement and a prioritisation of emergency services. In the event of such an exception, the Law provides that an entity must not cause harm to the users, act proportionally, transparently, and equally, inform users and offer services on a non-discriminatory commercial basis and not engage in anti-competitive conduct.
