Brazil: Implemented Civil Rights Framework for the Internet including Net neutrality measures

On 24 June 2014, the Civil Rights Framework for the Internet (Law No 12.965/2014) entered into force. The Law introduces a set of rules concerning net neutrality. In particular, the Law stipulates that internet service providers have the duty to treat the transmission of all data packets on an equal basis, without discrimination by content, except if it is a technical requirement and a prioritisation of emergency services. In the event of such an exception, the Law provides that an entity must not cause harm to the users, act proportionally, transparently, and equally, inform users, offer services on a non-discriminatory commercial basis, and not engage in anti-competitive conduct.
