On 20 October 2021, the Federal Senate of Brazil approved the constitutional amendment PEC No. 17/2019 that adds the protection of personal data to the list of the fundamental rights listed in the Brazilian constitution and extends the right to data protection to the digital environment. Under the new amendment, the Federal Government is responsible for legislating and supervising the protection of personal data and the way personal data is processed. The proposal was approved unanimously and is now transferred to National Congress for promulgation and enactment.
