Entry into force with grace period of Amendment to Tourism Law Regulating Digital Hosting Platforms including registration requirement

On 5 April 2024, the Amendment to the Tourism Law, which is specifically aimed at regulating digital accommodation platforms, entered into force. The amendment introduces a host registry, where property owners must register with the city if they intend to rent out their properties on digital platforms. This registry serves as a central database to track and monitor hosts operating in the city's lodging market. Further, the platforms are also required to register with the city. Hosts are mandated to submit semi-annual reports on the occupancy of their properties. Moreover, hosts must provide detailed financial information, including their name, identification, Federal Taxpayer Registration Number (RFC), proof of tax status, and documentation proving ownership or possession of the property offered for rent. Accommodations listed on digital platforms must display the host's contact information and proof of registration in the host census. The Secretariat of Tourism of Mexico City and the Digital Agency for Public Innovation are required to establish the register within 180 days, and the platforms will have 30 days to complete their registration.
