On 6 January 2021, Bill H.5250 was introduced in and passed by both houses of the Massachusetts state legislature. Section 98 (Delivery Fee Cap Statute) of the Bill stipulates that food delivery service fees to restaurants may not exceed 15% of the sales price of an order. The Bill will be passed to the Governor for approval. The Cap would be in force until the state of emergency called in response to the COVID-19 pandemic ends.
