On 15 February 2024, the Bill expanding definition of sensitive personal information to include neural data (SB 1223) was introduced to the California Legislature. The Bill amends the California Consumer Privacy Act of 2018 (CCPA) to include the definition of “neural data” as information generated by the measurement of the activity of an individual's central or peripheral nervous systems that can be processed by, or with the assistance of, neurotechnology. The Bill defines neurotechnology as a device or instrument that enables a connection with a person's central or peripheral nervous system for purposes such as reading, recording, and modifying a person's brain activity.
