United States of America: Adopted Bill relating to the Use of Artificial Intelligence by public bodies (SB 487)

On 8 March 2024, the Bill relating to the Use of Artificial Intelligence by public bodies (SB 487) was adopted by the General Assembly of Virginia. The Bill mandates the the Joint Commission on Technology and Science (JCOTS) to conduct an analysis of the use of artificial intelligence (AI) by public bodies in the Commonwealth. The analysis, carried out in consultation with relevant stakeholders, will focus on establishing policies and procedures governing the procurement, implementation, and ongoing assessment of AI systems by public bodies. Key considerations include preventing unlawful discrimination or disparate impact and ensuring public bodies assess and address potential discriminatory effects. In addition, the Bill requires an assessment of the possibility of creating a Commission on Artificial Intelligence to advise the General Assembly on AI-related issues, with details on its composition and duties aligned with non-discrimination principles. JCOTS is required to submit a comprehensive report with findings and recommendations to specified House and Senate Committees by 1 December 2024.
