Closed Consultation on the draft Data Regulation Implementation Act

On 1 April 2024, the Ministry of Economic Affairs and Climate Policy closed its consultation on the draft law for the implementation of EU Regulation 2023/2854 on harmonised rules for fair access to and fair use of data. The draft law designates the Netherlands Consumer and Market Authority (ACM) as the competent authority for most chapters of the Data Regulation and the Dutch Data Protection Authority (AP) as the authority for the chapter on data from public bodies. It also sets out rules for cooperation and exchange of information between the ACM and AP, and gives them powers to impose fines and periodic penalty payments for violations.
