On 15 February 2024, the European Parliament and the Council of the European Union reached a provisional agreement on the Proposal for a Regulation on the Extension of Derogation from the ePrivacy Directive until 3 April 2026, specifically for the purpose of identifying Child Sexual Abuse Material (CSAM) online. The extension concerns an exemption from data protection regulations, which grants providers offering number-independent interpersonal communication services, such as messaging services, the authority to use particular technologies for processing personal and other data to identify, report, and remove instances of online child sexual abuse on their platforms. Negotiators from the Council and European Parliament have also agreed that, for the purpose of achieving comprehensive reporting and comparable statistics, providers must ensure that information regarding reports of detected online child sexual abuse submitted to authorities and the Commission is accessible in a structured format. This agreement must be confirmed by the EU member states' representatives and will be sent to Parliament and Council for adoption.
