China: Automobile Data Security Provisions including data protection requirements enter into force

The Provisions on the Security Management of Automobile Data (Trial) entered into force on 1 October 2021. As compared to the draft provisions, there have been changes in how personal information and sensitive personal information are defined. In the adopted Provisions, the need to ensure safe driving appears more prominently as a consideration alongside privacy. Violations of these provisions may be punished in accordance with the "Network Security Law of the People's Republic of China", "Data Security Law of the People's Republic of China" and other laws and administrative regulations.
