Adopted Civil Rights Framework for the Internet including copyright and related rights regulation (Law No 12.965/2014)

On 23 April 2014, the Brazilian parliament adopted the Civil Rights Framework for the Internet (Law No 12.965/2014). The Law states that user-generated content that violates copyright or related rights is subject to specific legal provisions that must respect the freedom of expression and other guarantees in Article 5 of the Federal Constitution. However, the Law states that until these specific legal provisions enter into force, the copyright legislation will be applicable to any damages resulting from content on platforms that infringe copyright or related rights.
