EDPB issues opinion on adequacy of the South Korean data protection regime

Following the launch of the formal process of the adequacy decision regarding the Republic of Korea on 16 June 2021, the European Commission asked EDPB issued its opinion assessing the adequacy of the level of protection afforded in the Republic of Korea. The EDPB concluded that many aspects of the Korean data protection framework are equivalent to the European data protection framework. Still, certain aspects require closer attention, monitoring and clarification, including the exemption of pseudonymized data from many provisions, the limited right to withdraw consent, the level of data subjects' information when consenting to data transfers, the sharing of personal data by telecommunication providers to national security authorities and the complaint mechanism.
