Issued ruling in ACMA investigation into Uber's alleged violation of spam laws

On 26 October 2023, the Australian Communications and Media Authority (ACMA) issued its ruling in its investigation into Uber, imposing a fine of USD 412'500 for violating the Australian Spam Act by sending over 2 million marketing emails without an unsubscribe option. The ACMA noted that Uber conducted a one-day advertising campaign for an alcohol home delivery service. The ACMA found that more than 500’000 emails were sent to customers who had previously unsubscribed. The investigation determined that Uber had mischaracterised these emails as non-commercial.
