Opened consultation on Utah Social Media Regulation Act Rule including age verification requirement

On 15 October 2023, the Utah Department of Commerce's Division of Consumer Protection published the Social Media Regulation Act Rule including the age verification requirement and opened a public consultation until 5 February 2024. The Rule requires social media companies to minimise data collection for age verification to the least amount of data reasonably necessary to verify age and collect consent. Further, the Rule lists requirements regarding age verification and existing technologies that can accurately verify the age. Finally, the Rule includes requirements regarding consent data, including maintenance per the Utah Consumer Privacy Act, data transfer restrictions, deletion requirements and record-keeping requirements for social media companies.
