Announced EU Commission investigation into TikTok’s compliance with DSA requirements to address illegal content and disinformation

On 19 October 2023, the European Commission sent a request for information to TikTok regarding risk assessments and mitigation measures adopted under the Digital Service Act (DSA) to address the dissemination of illegal content and disinformation and protect the integrity of elections. In particular, TikTok is asked to provide information on the dissemination of illegal content, specifically terrorist and violent content, hate speech and alleged disinformation. Furthermore, the request focuses on TikTok's compliance with additional DSA obligations, specifically the protection of minors online. The measures regarding the Israel-Palestine conflict and further illegal content have to be provided until 25 October 2023. Measures undertaken to ensure the integrity of elections and safeguard minors must be submitted by 8th November 2023. The Commission may issue fines in accordance with Article 74 of DSA for inadequate, false, or misleading information or initiate further proceedings.
