Announced EU Commission investigation into TikTok’s compliance with requirements regarding protection of minors under the DSA

On 9 November 2023, the Commission of the European Union sent a request to TikTok regarding the measures adopted to comply with the requirements regarding the protection of minors under the Digital Service Act (DSA). In particular, TikTok has to submit information regarding the risk assessment conducted and the measures adopted to address the identified risks, including those related to mental health and physical health, to ensure the protection of minors. Previously, TikTok was designated as a very large online platform, making it subject to the obligations under DSA. TikTok has to provide the information by 30 November 2023. In case of non-compliance, the Commission can issue a formal decision, open proceedings against it, and impose penalties.
