On 9 June 2023, the UK's Court of Appeal granted the Competition and Market Authority's (CMA) request for permission to appeal the ruling of the Competition Appeal Tribunal (CAT), issued on 31 March 2023, which determined that the CMA’s investigation into Apple and Google’s “effective duopoly” over mobile browser and cloud gaming services through app stores was beyond its powers given that it was announced outside the time limit of 12 months after a market report was published. The appeal is to be heard on the first available date after 2 October 2023. Until the Court’s judgment, the CMA’s investigation continues to be stayed.
