On 5 October 2023, the Federal Antimonopoly Service (FAS) announced that the Ninth Arbitration Court of Appeal rejected Apple's appeal against the Supreme Court, which upheld the legality of the RUB 906 million (approx. USD 12 million) fine imposed on Apple by the FAS for abusing its dominant position in the iOS parental control app market. The FAS, following an investigation into Apple, determined that it abused its dominant market position as operator of the sole marketplace for apps on iOS to provide a competitive advantage to its own parental control products while worsening the distribution conditions of its competitors. Further, Apple has been ordered to give up on its ability to reject applications from the app store even where they meet all requirements and to ensure that its own applications do not take precedence over third-party applications.
