Issued General Court interim ruling in Amazon lawsuit against European Commission regarding designation as Very Large Online Platform (Case T-367/23)

On 27 September 2023, the European General Court delivered an interim decision in the legal dispute between Amazon and the European Commission concerning the classification as a Very Large Online Platform (Case T-367/23). Amazon requested a provisional measure from the General Court to pause the implementation of Digital Services Act (DSA) obligations related to creating and disclosing an advertising repository and offering users a non-profiling-based option for each recommendation system. The Court granted Amazon's request, which will not be required to create and disclose an advertising repository and offer users a recommendation system that is not based on profiling until the Court decides whether Amazon is a Very Large Online Platform.
