China: Opened Consultation on Law on Administrative Penalties for Public Security including cybersecurity regulation

On 7 September 2023, a public consultation on the draft of the revised Law on Administrative Penalties for Public Security was opened until 7 October 2023. The regulation would add new punishable behaviours. In the context of cybersecurity and hacking, Article 32 prohibits the following: intruding in a computer information system, changing or deleting computer information systems, modifying or deleting data stored in computer information systems, or providing programs performing the mentioned tasks. A violation of Article 32 may result in an administrative penalty of detention up to 15 days.
