On 10 July 2023, the Swiss Federal Data Protection Authority (EDÖB) issued a statement acknowledging the adoption of the EU-US Data Privacy Framework and the corresponding EU Adequacy Decision. EDÖB announced that, in parallel, Switzerland is actively negotiating a similar framework with the United States, referred to as the Swiss-U.S. Data Privacy Framework. Commencing 1 September 2023, the responsibility for evaluating the adequacy of foreign countries under the newly enacted Swiss data protection legislation will rest with the Federal Council. It will be at the discretion of the Federal Council to determine whether the United States can be included in the list of countries deemed adequate at an appropriate juncture. Until the Swiss-U.S. Data Privacy Framework is formalised, Switzerland's list of countries considered adequate for data protection will remain unaltered.
