Issued DSK opinion on Draft Ordinance on Consent Management Services

On 11 July 2023, the Data Protection Conference (DSK) adopted its opinion on the Draft Ordinance on Consent Management Services (Einwilligungsverwaltungsverordnung – EinwV). In general, the DSK advocates for introducing the EinwV as a sensible means of having a positive effect on consumers being tired of consenting by allowing website users to specify their consent preferences only once. However, the DSK recommends that the Regulation not eliminate cookie consent banners on websites in order to comply with consent requirements under the Federal Act on the Regulation of Data Protection and Privacy in Telecommunications and Telemedia (TTDSG) and Articles 6(1)(a) and 49(1)(a) of the GDPR.
