Brazil: Closed consultation on preliminary study on processing of personal data based on legitimate interest

On 30 September 2023, the Brazilian National Data Protection Authority (ANPD) closed its consultation on the preliminary study on processing personal data based on legitimate interests. The ANPD extended the deadline for submitting comments on 5 September 2023, from 15 September to 30 September. The processing based on legitimate interest is established in Article 7 of the General Law for the Protection of Personal Data (No. 13,709). The preliminary study on the processing of personal data based on legitimate interest aims to provide legal hypotheses and a foundation for guidelines on the legitimate interest concept by combining the technical knowledge of the authority with practical insights from data processing entities.
