Brazil: Opened consultation on preliminary study on processing of personal data based on legitimate interests

On 16 August 2023, the Brazilian National Data Protection Authority opened its consultation on the preliminary study on processing personal data based on legitimate interests until 30 September 2023. The processing based on legitimate interest is established in Article 7 of the General Law for the Protection of Personal Data (No. 13,709). The preliminary study on the processing of personal data based on legitimate interest aims to provide legal hypothesises and a foundation for guidelines on the legitimate interest concept by combining the technical knowledge of the authority with practical insights from data processing entities.
