On 7 September 2023, the Cyberspace Administration of China (CAC) closed its consultation on the draft Regulations for the use of facial recognition technology. In particular, face recognition technology may only be used with the individual’s consent, when there is a specific purpose and sufficient necessity, and adequate protection measures are taken. Image-capturing devices may only be installed in public places for the purpose of protecting national security, public safety, life, health and property. Image-capturing devices may not be installed in places that infringe privacy such as hotel rooms or public toilets. A data protection impact assessment is required for the processing of face information.
