Opened consultation on draft Regulations for the use of facial recognition technology including data protection regulation

On 8 August 2023, the Cyberspace Administration of China (CAC) opened a consultation on the draft Regulations for the use of facial recognition technology until 7 September 2023. In particular, face recognition technology may only be used with the individual’s consent, when there is a specific purpose and sufficient necessity, and adequate protection measures are taken. Image-capturing devices may only be installed in public places for the purpose of protecting national security, public safety, life, health and property. Image-capturing devices may not be installed in places that infringe privacy such as hotel rooms or public toilets. A data protection impact assessment is required for the processing of face information.
