On 16 February 2023, Assembly Bill 1194 amending the California Privacy Rights Act was introduced to the California State Assembly. The Bill provides that a consumer accessing, procuring, or searching for services regarding contraception, pregnancy care, and perinatal care, including abortion services, does not constitute a natural person being at risk or danger of death or serious physical injury. Consequently, businesses handling this information are exempt from the obligation to provide information to authorities requesting emergency access to a consumer’s personal information if a natural person is at risk or in danger of death or serious physical injury.
