Signed Genetic Information Privacy Act (SB 351)

On 7 June 2023, the Genetic Information Privacy Act was signed by the Governor of Montana. The Act outlines requirements for businesses that collect and process genetic data in order to safeguard the privacy, confidentiality, security, and integrity of the data. In particular, businesses will be required to clearly disclose to customers the policies and standards of collection, use, or disclosure of genetic data. Consumer consent is required for marketing to a consumer based on the consumer's genetic data and for the sale of genetic data. Businesses are also required to provide consumers with a procedure to request access and deletion of genetic data and to revoke consent.
