On 2 May 2023, the Genetic Information Privacy Act was adopted by the Montana Legislature. The Act outlines requirements for businesses that collect and process genetic data in order to safeguard the privacy, confidentiality, security, and integrity of the data. In particular, businesses would be required to clearly disclose to customers the policies and standards of collection, use, or disclosure of genetic data. Consumer consent is required for marketing to a consumer based on the consumer's genetic data and for the sale of genetic data. Businesses are also required to provide consumers with a procedure to request access and deletion of genetic data and to revoke consent.
