On 4 May 2023, the Florida Digital Bill of Rights (SB 262) was adopted by the Florida House of Representatives. The Bill aims to enhance technology transparency by establishing key definitions such as biometric information, controller and processor, de-identified and genetic information, and personal information and establishing data rights. The Bill outlines requirements for data controllers for collecting personal data and would require establishing reasonable security measures to safeguard personal data. Additionally, the Bill establishes data privacy rights, including the ability to request personal data deletion or correction. Further, Bill would establish the individuals right to opt out of their data being sold or shared with third parties. Finally, the Bill specifies that online platforms providing services that children access are prohibited from processing children's personal information if it may result in harm or privacy risk to children.
