On 11 May 2023, the European Parliament (EP) adopted the Resolution on the Draft Implementing Decision by the European Commission on adequate protection of personal data under the EU-US Data Privacy Framework. In light of the Schrems I and II decisions, the data privacy standards are being rewritten in the form of the EU-US Data Privacy Framework. The EP voted to adopt the Resolution, which recommends European Union (EU) not grant the United States (US) an adequacy decision. The Resolution concludes that the Data Privacy Framework is an insufficient change from the original Privacy Shield and therefore does not have the same level of protection as the General Data Protection Regulation (GDPR). The Resolution notes that the Parliament recognises the efforts and changes the US has proposed and expects meaningful adjustments by October 2023. The Commission is called to continue negotiations with the US to facilitate the recommended adjustments.
