On 1 October 2018, the Agreement between the United States of America, Mexico, and Canada was reached. The agreement establishes that no Party shall restrict the cross-border transfer of information, including personal information, except in the cases where it is necessary to achieve a "legitimate public policy objective". However, such measures shall be proportionate to the objective and not constitute arbitrary or unjustifiable discrimination or restriction on trade. The Agreement will enter into force on the first day of the third month following the last ratification of the participating countries.
