On 1 July 2020, the Agreement between the United States of America, Mexico, and Canada entered into force, after the last ratification of Canada on March 13, 2020. Article 19.11 establishes that no Party shall restrict the cross-border transfer of information, including personal information, except in the cases where it is necessary to achieve a "legitimate public policy objective". However, such measures shall be proportionate to the objective and not constitute arbitrary or unjustifiable discrimination or restriction on trade.
