Issued ruling partially revoking injunction suspending and fining Telegram

On 29 April 2023, the Second Specialized Panel from the Regional Federal Tribunal in Brazil (TRF2) issued a partial suspension of the injunction that mandated the temporary suspension of the Telegram application in Brazil. The ruling was issued in response to the appeal filed by Telegram against the measure imposed by the Federal Court of Linhares in Espírito Santo, suspending its operations and imposing a fine. According to the TRF2 judge, the complete suspension of the service is deemed unreasonable due to its broad impact on the freedom of communication for numerous individuals who have no connection to the ongoing investigation. However, the TRF2 judge upheld the daily fine of BRL 1 million imposed by the lower court due to non-compliance with the order to provide data for all users of the "Movimento Anti-Semit Brasileiro" channel and the "Anti-Semitic Front (Swastika)" chat.
