On 19 February 2021, the South African Competition Commission (CCSA) released the draft terms of reference for an eventual market inquiry into online intermediation platform services (OIPMI). The draft terms of reference show the grounds upon which the CCSA is investigating. The CCSA is legitimized for investigations like these through section 43B(1)(a) of the Competition Act 89 of 1998. The inquiry targets online intermediation platforms, which act as intermediaries between businesses and customers. It includes but is not limited to eCommerce and mobile application stores. To be examined are possible violations of competition law between online intermediation platform providers as well as between suppliers of goods and services in the form of unilateral conduct and conglomeration, among others.
