Implemented Provisions on Administrative Law Enforcement Procedures for Internet Information Departments

On 1 June 2023, the Provisions on Administrative Law Enforcement Procedures for Internet Information Departments by the Cyberspace Administration of China (CAC) were implemented. The new Provisions include rules outlining the scope and procedures for investigative practices, enforcement actions, and jurisdiction applying to government departments overseeing administrative punishment or enforcement in cybersecurity and data-related cases where there are violations of relevant data protection and security regulations. The Provisions also set out the process for administering administrative punishments, including allowing the imposing of a 3% additional fine for each day of non-compliance with a penalty.
