Issued ruling in Wish appeal case of DGCCRF delisting ruling

On 21 October 2022, the Constitutional Council issued its ruling in the case brought before the court by Wish, appealing the General Directorate for Competition, Consumer Affairs and Fraud Prevention (DGCCRF) order to Google Ireland Ltd, Qwant SAS, Microsoft Corporation and Apple Inc to delist the e-commerce platform and its application from the search engines and mobile application store. Wish argued that article L521-3-1 Consumer Code is a disproportionate attack on the freedom of expression and communication, as well as on the freedom of enterprise. The Constitutional Council found that the Consumer Code is constitutional, and strengthening consumer protection and ensuring the fairness of online commercial relations is compatible with the freedom of enterprise.
