Introduced Everyone can Notice and-Take down Distribution of Child Sexual Abuse Material Act (END CSAM Act- SB 823)

On 15 March 2023, the Everyone can Notice and-Takedown Distribution of Child Sexual Abuse Material Act (END CSAM Act- SB 823) was introduced in the United States Senate. The Bill would hold social media companies liable for hosting or distributing child sexual abuse material. The Bill also would prohibit social media companies from "knowingly" or "recklessly" hosting or distributing child pornography and impose civil penalties of no less than USD 100'000 and no more than USD 500'000 on those who violate the provision. The Bill also requires social media companies to provide a notification mechanism for persons who want to report content in clear violation of the ban and to designate an agent to receive such notifications. The Bill provides liability protection for social media companies that disable access to such visual representations or take them down in good faith.
