Consultation closed on Netherlands Digital Markets Act Implementation Act

On 10 April 2023, the Government of the Netherlands closed its consultation on the Digital Markets Act Implementation Act. In particular, the Act designates the Netherlands Authority for Consumer and Markets (ACM) as the competent authority for supervising compliance of the Digital Markets Act (DMA) in the Netherlands. In addition, the Act provides that the ACM will assist the European Commission in investigations under the DMA and also authorises the ACM to conduct independent investigations. The Act would effectively subject companies designated as “gatekeepers” under the DMA to additional investigations by the ACM regarding their compliance with the regulation in the Netherlands.
