On 24 February 2023, the Deterring America's Technological Adversaries (DATA) Act of 2023 (HR 1153) was introduced in the United States House of Representatives. The Act aims to clarify the unenforceability of certain regulations and restrictions on sensitive personal data under the International Emergency Economic Powers Act (IEEPA). In particular, the Act would give the US President the power to impose sanctions, as specified in IEEPA, on those who do not comply with the DATA Act. Furthermore, the Act would require the US President to assess any potential violation of IEEPA by TikTok and Bytedance and adopt orders banning the application federally if it concludes that TikTok operates directly or indirectly on behalf of China or contributes to China's development of military and surveillance technologies and algorithms capable of manipulation or facilitates election interference.
