Passed Informing Consumers about Smart Devices Act (HR 538)

On 27 February 2023, the House of Representatives passed the Informing Consumers about Smart Devices Act (HR 538). The Act would require the Federal Trade Commission (FTC), no later than 180 after the Act's entry into force, to issue disclosure guidelines for manufacturers of certain internet-connected devices, such as home appliances with audio or visual recording components, to disclose these functions to consumers. Specifically, it would apply to internet-connected appliances with a camera or microphone. The Act will not apply to devices that consumers expect to be equipped with cameras or microphones, such as mobile phones or laptops. The Act would apply only to appliances that consumers don't expect to incorporate video or audio recording features. The FTC Guidelines would be binding on the manufacturers 180 days after their adoption. The Act now goes to the Senate for adoption.
