United States of America: Introduced Deterring America's Technological Adversaries Act of 2023 (HR 1153) including cross-border data transfer regulation

On 24 February 2023, the Deterring America's Technological Adversaries (DATA) Act of 2023 (HR 1153) was introduced in the United States House of Representatives. The Act aims to clarify the unenforceability of certain regulations and restrictions on sensitive personal data under the International Emergency Economic Powers Act (IEEPA). In particular, the Act would empower the Secretary of the Treasury to issue a directive prohibiting sensitive personal data transfers from the United States to certain entities operated directly or indirectly, influenced or owned by China.
