Announced Nigeria Data Protection Bill 2022 including cross-border data transfer regulation

On 25 February 2023, the Nigerian Federal Executive Council (FEC) approved the Nigeria Data Protection Bill 2022, containing cross-border data transfer regulation, which will now be introduced in the National Assembly. The Bill prohibits data controllers or data processors from transferring or permitting to be transferred personal data from Nigeria to another country unless either: (1) the recipient of the personal data is subject to rules affording an adequate level of data protection, defined as a substantially similar level of protection as that provided by the Bill; or (2) a number of other conditions are met, such as obtaining prior consent of the data subject.
