Introduced Act Relative to Internet Privacy Rights for Children (HD 2325) including content moderation

On 19 January 2023, An Act Relative to Internet Privacy Rights for Children (HD 2325) was introduced in the House of Representatives of the Commonwealth of Massachusetts. The Act would apply to online service providers as well as providers of mobile applications and websites directed to minors. Covered entities would be prohibited from advertising, among others, the following products: alcohol, firearms, tobacco products, lottery tickets, tattoos and fireworks. Covered entities would be required to take "reasonable actions in good faith" to avoid advertising the aforementioned products. Covered entities would also be required to ensure that minors can either remove content on the operator's online service themselves or request the removal of content posted by the user. The Attorney General would enforce the Act and may sanction any operator with a fine of USD 2500 per violation.
