European Union: Published Draft Gigabit Recommendation including competition measures

On 23 February 2023, the European Commission published the Recommendation on the regulatory promotion of gigabit connectivity (draft Gigabit Recommendation), which provides guidance to National Regulatory Authorities about the conditions for accessing the networks of operators with significant market power. The draft Recommendation aims to ensure, when appropriate that all operators can access existing network infrastructure. The draft Recommendation has been sent to the Body of European Regulators for a two-month consultation, following which the Commission will adopt its final Recommendation.
