European Union: Opened consultation on Implementing Regulation on detailed arrangements for the conduct of certain proceedings by the Commission pursuant to Digital Services Act

On 16 February 2023, the public consultation opened on Implementing Regulation on detailed arrangements for the conduct of certain proceedings by the Commission pursuant to the Digital Services Act until 16 March 2023. The Regulation outlines the procedures the European Commission will follow in its investigations into providers of very large online platforms or of very large online search engines. In particular, the Regulation implements the articles regarding the Commission's power to conduct inspections, adopt interim measures to address providers' non-compliance, make the commitments binding and outline monitoring actions. Furthermore, the Regulation outlines the procedures for sharing documents and the steps that will be taken to uphold the provider's right to be heard and access the file.
