United States of America: Opened consultation on Artificial Intelligence and Inventorship

On 14 February 2023, the United States Patent and Trademark Office (USPTO) opened a public consultation on Artificial Intelligence and Inventorship until 15 May 2023. The USPTO aims to gather information regarding AI involvement in the creation process and the distinctive characteristics that differentiate it from other technological tools. Furthermore, the USPTO requests information from stakeholders on the specific issues involving patent law, including whether inventions are patentable when AI is applied and whether that changes depending on the number of humans involved in the process. The USPTO also inquires whether the industry believes that being able to list AI as an inventor in patents would support or hamper innovation.
