On 18 January 2023, Senate Bill 21 proposing an amendment to the Hawaii State Constitution establishing the right to own one’s own data was introduced to the Hawaiian Senate. If passed, the Bill would create a state constitutional right of each person to own and have an exclusive property right over the data they generate on the Internet. Closer determination of the types of data in question, as well as the manner of implementation and enforcement, would be subject to further definition by the legislature.
