On 13 January 2023, the European Commission opened a public consultation on its initiative to adopt a Recommendation on combating online piracy of live content until 10 February 2023. In particular, the Recommendation would provide Member States and private entities the tools necessary to address the illegal streaming of live events online. In its initiative, the Commission stated that it aims to identify the EU legal instruments that could be used to prevent online piracy based on the “illicit capture of the broadcast signal”. Furthermore, the Commission aims to clarify how private entities and Member States can use the obligations listed in Digital Service Act and the Directive on the harmonisation of certain aspects of copyright and related rights in the information society to combat the online piracy of live content. The Recommendations will be adopted in the second quarter of 2023.
