Issued ruling in CNIL investigation into TikTok's personal data processing

On 29 December 2022, the Commission Nationale de l'Informatique et des Libertés (CNIL) issued its ruling in the investigation of the Tiktok webpage, issuing a fine of EUR 5 million. In its ruling, CNIL stated that Tiktok failed to comply with Article 82 of the French Data Protection Act, which requires electronic communication service providers to inform and obtain the user's consent before accessing or entering information in a user's terminal equipment. The CNIL found that users could more easily accept cookies than refuse them. Users were also not informed with enough transparency about the purpose of the cookies.
